Your rights
Inspect and obtain a copy of your records
You may ask to inspect or receive an electronic or paper copy of your medical record and other health information we maintain about you. We generally respond within 30 days, subject to applicable extensions and exceptions. We may charge a reasonable cost-based fee where permitted.
Request correction of records
You may ask us to amend information you believe is inaccurate or incomplete. We may deny a request as permitted by law, but generally will explain the reason in writing within 60 days.
Request confidential communications
You may ask us to contact you in a particular way or at a different location. We will accommodate reasonable requests. Clinical messaging for Direct Access members is available through the designated Spruce channel; normal email and SMS should not be used to send sensitive medical information unless specifically directed by the practice.
Request restrictions on sharing
You may ask us to limit uses or disclosures for treatment, payment, or health care operations. We are not generally required to agree, except that if you pay out of pocket in full for a service or item, you may require us not to disclose that information to your health plan for payment or health care operations, unless disclosure is required by law.
Receive an accounting of disclosures
You may ask for a list of certain disclosures made during the preceding six years, subject to applicable exclusions, including many treatment, payment, or operations disclosures. One accounting in a 12-month period is free; additional accountings may incur a reasonable cost-based charge.
Get this notice and designate a representative
You may request a paper copy of this notice at any time. An authorized personal representative, such as a legal guardian or person holding applicable legal authority, may exercise rights on your behalf, subject to verification.
Complain without retaliation
If you believe your privacy rights have been violated, contact our Privacy Contact above or file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights, 200 Independence Avenue SW, Washington, DC 20201; 1-877-696-6775; https://www.hhs.gov/hipaa/filing-a-complaint/index.html. We will not retaliate against you for making a complaint.
Your choices and required authorizations
You may tell us your preferences about sharing information with family, friends, or other persons involved in your care or payment for care, and in disaster relief situations. If you cannot tell us your preference, we may share information when legally permitted and in your best interests, or to avert a serious and imminent threat.
Your written authorization is generally required for marketing uses or disclosures that require authorization, any sale of protected health information, and most uses or disclosures of psychotherapy notes. You may revoke an authorization in writing, except to the extent we already relied on it. We do not sell patient health information. If the practice conducts fundraising using protected health information, applicable notice and opt-out rights will be provided.
How we use and disclose information
Care, practice operations, and payment
We may use or disclose health information to diagnose, treat, and coordinate your care with other clinicians; to operate the practice, improve services, conduct quality reviews, and contact you about care; and to collect payment or handle billing. For example, with appropriate safeguards we may share relevant health information with a specialist involved in your treatment.
Other permitted or required uses
Where permitted or required by law and subject to applicable conditions, we may use or disclose information for public health reporting, preventing or reducing serious threats to health or safety, health oversight, research, mandatory reporting of suspected abuse or neglect, workers compensation, organ and tissue donation, medical examiners or funeral directors, appropriate law-enforcement and government activities, and judicial or administrative proceedings, including responses to valid orders or legal process.
Additional protections for specially protected information
Certain records, including HIV-related information, certain mental-health treatment records, and drug or alcohol treatment records, may have protections under Pennsylvania or federal law that are stricter than the general HIPAA rules. We apply those additional restrictions when they govern a particular record or disclosure, and obtain any specially required consent or authorization. This notice does not replace a separate consent required by law.
If we receive or maintain substance use disorder patient records that are subject to 42 CFR Part 2, those records receive additional protection. Such Part 2 records generally may not be used or disclosed in civil, criminal, administrative, or legislative proceedings against you without your written consent or a qualifying court order accompanied by the process required by Part 2. Other Part 2 uses and disclosures remain subject to that law, including rules governing treatment, payment, health care operations and consent where applicable.
Our responsibilities
We are required by law to protect the privacy and security of your protected health information.
We must provide notice of our privacy practices and follow the currently effective notice.
We will notify affected individuals of breaches of unsecured protected health information when required by law.
We will not use or share your information beyond what the law or this notice permits without your written authorization, which you may revoke prospectively.
We may change this notice and apply the new terms to information we already hold. A current copy will be available at our office, upon request, and on our website at drseltzerlifestylemedicine.com.
Communication and website privacy
Direct Access members are instructed to communicate clinical concerns using our designated secure Spruce messaging application. Spruce is not an emergency service. In emergencies, call 911 or seek emergency treatment. This HIPAA Notice concerns patient medical information maintained by the practice; it is different from any separate website cookie, analytics, or visitor privacy disclosures.
